Legal intervention and submission

LEGAL INTERVENTION AND SUBMISSION.

Australian Immigration laws change quite frequently. Therefore, to receive accurate and up-to-date information, please contact an Australian migration firm or a Registered Migration Agent with OMARA in Australia.

If you are not fully confident in or satisfied with the quality of service from a Migration firm, you are free to seek a more suitable one. This decision will not affect the outcome of your case.

JL Migration & Education is proud to be one of the Migration firms that has successfully intervened, resolved, and achieved success in many complex cases. We thoroughly review and complete the files we intervene in according to the standards set by the Department of Home Affairs.

During the review of your case, before making a final decision, if the Department of Home Affairs finds that your file lacks some necessary documents or has serious concerns that require your explanation, they will send you or your legal representative a Section 57 (Natural Justice Letter) or a Section 56 (Request for Further Information).

The process of legal intervention and explanation regarding adverse points in a Client’s file is always complex and requires a high level of expertise.

1. Distinguishing between S57 and S56

** S57 (Section 57 - Natural Justice Letter)
S57 (Section 57 - Natural Justice Letter), also known as the "Invitation to Comment on (Adverse) Information" is a letter issued when the Department of Home Affairs suspects that a fraudulent document or misleading information has been provided.
This is a serious issue - that requires immediate professional advice.
** S56 (Section 56 Request for Further Information)

A Section 56 Request for Further Information (RFI) letter is typically a straightforward request from the Department of Home Affairs for additional information or documentation to support the ongoing assessment of your case.
Sometimes, this request may be as simple as providing an Australian police clearance or completing a health check..

2. Reasons that may require you to provide a submission for your Visa

  • PIC 4020 - The application contains false declarations or involves a fraudulent marriage.
  • Invalid or fraudulent documents.
  • A Partner Visa is suspected of being a fake marriage, or someone has reported the relationship as not genuine.
  • Discrepancies between the information provided in your statement and the documentation submitted.
  • Discovery of unauthorized work while holding a Visa that does not permit employment.
  • Failure to meet health standards.
  • Criminal convictions.
  • The sponsor has sponsored more than two people already.

JL Migration & Education is always a trusted choice with extensive experience in intervening and handling cases that require detailed submissions.

Please note that this is a complex issue, and at JL Migration & Education, we are professionally trained and licensed to provide advice, intervention, and processing for highly complex cases. Be wise and discerning in choosing a partner with the capability and dedication to support you effectively.
